Please Read Carefully: These Terms contain a binding arbitration clause and class action waiver in Section 16. Please read that section carefully — it affects how disputes between you and Moreland University are resolved.

These Terms should be read alongside our Privacy Policy, which is incorporated herein by reference.

12.  THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites and services that are not owned or controlled by Moreland University. We provide these links as a convenience and do not endorse or assume any responsibility for the content, privacy practices, or terms of any third-party site.

The Site also uses cookies, pixels, tags, analytics tools, advertising technologies, and similar tracking technologies provided by third-party service providers. Our use of these technologies, including your choices and controls, is described in our Privacy Policy.

Your interactions with third-party sites and services are governed solely by their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party sites you visit.

13.  DISCLAIMER OF WARRANTIES

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MORELAND UNIVERSITY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MORELAND UNIVERSITY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Licensing Outcomes: Moreland University offers teacher certification preparation. However, the award of a state teaching license is determined solely by the applicable state licensing authority. Moreland University cannot guarantee licensure outcomes, and successful completion of a Program does not guarantee employment or certification in any jurisdiction.

14.  LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MORELAND UNIVERSITY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL MORELAND UNIVERSITY’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MORELAND UNIVERSITY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

15.  INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Moreland University, its affiliates, and their respective officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your use of the Site or Services, your User Content or Student Work, or your violation of any third party’s rights.

16.  DISPUTE RESOLUTION AND ARBITRATION

Please Read Carefully: This section requires binding arbitration for most disputes and waives your right to a jury trial or participation in a class action. Review these provisions carefully before using the Site or enrolling in a Program.

Informal Resolution First

Before initiating any formal dispute proceeding, you agree to contact Moreland University at privacy@teach-now.edu with a written description of the dispute and your proposed resolution. We will attempt to resolve the matter informally within 30 days. If we cannot resolve the dispute informally, either party may proceed to arbitration as described below.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or Services that cannot be resolved informally shall be finally settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. The arbitration will be conducted in Washington, DC, or remotely at your option if you are located outside of Washington, DC. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

YOU AND MORELAND UNIVERSITY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

Note: These arbitration provisions are provided as a standard baseline. Moreland University recommends that these Terms be reviewed by qualified legal counsel before publication. State-specific consumer protection laws may affect the enforceability of certain provisions.

17.  GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. To the extent that any dispute is not subject to arbitration under these Terms, you consent to the exclusive personal jurisdiction of the federal and state courts located in Washington, DC, for the resolution of such disputes.

Moreland University’s programs are also subject to applicable state licensing and accreditation requirements. State-specific notices for students in Oregon, Maryland, North Carolina, Texas, and other states are set forth in the Course Catalog and Candidate Handbook.

18.  CHANGES TO THESE TERMS

Moreland University reserves the right to modify these Terms at any time. When we make material changes, we will update the “Effective Date” at the top of this document and provide notice as appropriate — which may include a banner on the Site or an email notification to enrolled students.

Your continued use of the Site or Services after the effective date of any revised Terms constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Site and Services.
